By using or visiting Go World Software Inc’s website (“Website”), you agree to these terms and conditions (“Terms”). Go World Software Inc (“GoWSI”) may, in its sole discretion, revise these Terms at any time without advance notice to you. It is your responsibility to check for any updates to these Terms.

 

If you do not agree to any part of these Terms, do not continue to use or access this website.

 

2 – Website – Public Areas

 

Many areas of the website are accessible without the creation of a user account. These areas are considered open to the public.

 

Our online Helpdesk system allows for the submission of a ticket with the creation of an account. This account, by default, only provides access to the Helpdesk and the tickets you have submitted. The Helpdesk is considered a public area of the website despite the requirement of registration.

 

3 – Website – Private Areas

 

Many areas of the website are accessible only via an authorized username and password combination. These areas are considered private and are only meant for access by GoWSI employees, employees or organizations that are presently using GoWSI’s software offerings, and individuals specifically authorized by GoWSI.

 

4 – Website – Access Terms

 

When accessing this website you agree to not attempt to access any information or areas which you have not been explicitly authorized for.

 

If you have an account for the website please make best efforts to ensure that nobody else knows your username and password combination. You are responsible for any activity that occurs using your account. GoWSI will not be responsible for any losses cause by unauthorized use of your user account.

 

You agree that you will not provide false information to GoWSI in the registration for or use of this Website, or any Content therein.

 

You may not use the Website for any illegal or unauthorized purpose. In addition to the laws of the Province of Alberta, Canada, you also agree to comply with all your local laws that apply to your use of the Website.

 

You will not attempt to disable, overburden, damage, or impair the Website, nor any of the servers or computer networks that are utilized by the Website, nor in a manner that will interfere with any other party’s use of the Website.

 

You acknowledge that GoWSI remains the owner of all intellectual property rights, including without limitation copyright and trademark rights, in all materials on or compromising the Website including, without limitation, all written, audio-visual, or other materials and graphical elements on the Website, excluding whatever information that you upload or provide to GoWSI during your use of the Website.

GoWSI will not disclose your contact information to third parties without your consent, except where required to do so by law.

You consent to emails from GoWSI relating to technical support requests, project management information, webinar announcements, and software update and bug fix notifications.

 

7 – Project Management

 

GoWSI keeps track of projects via a website application. While this application is protected through username and password authentication in combination with account restrictions, please exercise your judgement when it comes to the uploading of confidential information to the application.

 

8 – Helpdesk

 

GoWSI’s Helpdesk is a website application. While this application is protected through SSL, username and password authentication, and account restrictions please exercise your judgement when it comes to the uploading of confidential information to the application.

 

You agree that you will not deliberately upload files that contain bugs, viruses, trojan horses, worms, or any other similar software or programs that may damage the operation of the computer or property of another user or GoWSI.

 

9 – Documentation

 

GoWSI utilizes a documentation feature within the Helpdesk application to provide online documentation for end users. This documentation is considered confidential and is only for use by GoWSI personnel, client organizations of GoWSI, and other users explicitly authorized by GoWSI. You may feel free to print or download copies of the documentation for your reference but agree to not distribute the information to any third parties, except if required to by law.

 

10 – Disclaimer

 

Your use of this Website is entirely at your own risk. The Website and content is provided “as is” and without warranties or conditions of any kind, either expressed or implied. GoWSI does not warrant that the Website or Content will be uninterrupted or error free, that defects will be corrected, or that this website or the server that hosts it are free of viruses or other harmful components.

 

Without limiting the foregoing, GoWSI does not make and guarantee regarding the use, the ability to use, or the result of use of the Content in terms of accuracy, reliability, or otherwise. 11 – Limitation of Liability

 

GoWSI, its employees, agents, officers, and directors will not be liable for any direct, indirect, incidental, punitive, consequential, special, exemplary, or other damages, including, without limitation, loss of revenue or income, pain and suffering, emotional distress, or similar damages, or damages resulting from any errors or omissions in content; any unauthorized access to or use of our server and/or any and all personal information and/or financial information stored therein; any interruption or cessation of transmission to or from our website, any bugs, viruses, trojan horses, or the like, which may be transmitted to or through our website by any third party; or, for any loss or damage of any kind incurred as a result of your use of any Content posted, emailed, transmitted, or otherwise made available via the website. The foregoing limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction, regardless of the legal theory giving rise to the damages, and even if GoWSI has been advised of the possibility of such damages in advance.

 

You specifically acknowledge that GoWSI, its employees, agents, officers, and directors will not be liable for user content or the defamatory, offensive, or illegal conduct of any third party and that the risk of harm or damage from the foregoing rests entirely with you.

 

12 – Indemnity

 

You agree to defend, indemnify, and hold harmless GoWSI, its employees, agents, officers, and directors from and against any and all claims, damages, obligations, judgements, losses, liabilities, costs or debt, attorney’s fees, and other expenses arising from your use/access of the website; your violation of any third party right, including without limitation any copyright, property, or privacy right; or, any claim that you did not have the right to provide any user content or that your user content caused damage to a third party. This defense and indemnification obligation will survive these terms and your use of the Website. Should such a case arise, GoWSI will provide you with written notice of such claim, suit, or action via your provided email address.

 

13 – Miscellaneous

 

These terms shall be governed by and construed in accordance with the laws of the Province of Alberta, Canada. You agree to submit to the personal and exclusive jurisdiction of the courts located within the Province of Alberta, Canada.

 

You may not assign these Terms or assign/delegate these obligations, in whole or in part, whether voluntarily or by operation of law, without our prior written consent.

 

These Terms constitute the entire agreement between you and GoWSI with respect to the contained subject matter and supersede any current understandings or agreements, written or oral, regarding such subject matter.

 

If a court of competent jurisdiction finds any provision or portion of these Terms to be unenforceable the remaining provisions of the Terms will continue in full force and effect.

 

In the event of any inconsistency between the English and any other language version of these Terms, the English version shall govern.
